The Danger of Violating Prescribed Working Scope (Shanghai)

Expats shall be alerted to danger of working outside of the scope prescribed by their work permit. Those expats who fail to work with stipulated scope will be deemed to constitute illegal work and therefore subject to a penalty ranging between 5, Protected content 20,000 RMB or even deportation (in the case of expats having been illegally working in China for more than 3 months)

Normally, the reason for working outside of prescribed scope is set out as follows:

Inconsistency between the company stated on expats’ work permit/certificate of employment and the one expats actually work for.

This often happens when expats apply for work and residence permit through a company while being employed by another one. Under the Exit and Entry Law of China, the company stated on expats’ work permit/certificate of employment and the one expats actually work for must be the same.
